in a plea of 1/3 of vill of Longner, which she claimed in Dower WILLIAM dis not appear
Staffordshire - 1224 -Northamptonshire - Joan, widow of Henry s/o Ralph -vs- WILLIAM Duston
in a plea for 1/3 part of land in Duston , as her dower
WILLIAM Duston - pleaded that she had NO claim in the land, because her husband had never held the land in fee,
in as much as King John, when he was Earl of Mortain, had disseised WALKELINE, grandfather of said WILLIAM,
for a debt he owed to the said to said Henry afterwards King Richard had restored the lane to WILLIAM the
s/o Walkelin, the present WILLIAM claims as his rt & inheritance, by which her produced the charter & the charter
of King John
JOAN stated - that these charters should not prejudice her, because King Henry had given the land to Earl John, the earl gave
the land Richard FitzRoger, the brother of said Henry & Richard Had died siezed & after him Henry her husband held
by descent from his brother
WILLIAM Duston stated that Wakeline, his grandfather, ahd assumed the habit of Regigion in time of King Henry & the lands
remainded in the hands of his wife ALICE, who after wards married Peter s/o Ralph, who held the land jointly with
her until the Earl John had diseised them & Earl John conveyed to said Richard FitzRoger & his brother Henry
for a debt he owed them

Note: I must now give some account of the succession of—
JOAN or JULIANA NOEL, youngest daughter and coheir of Thomas Noel, and wife of Thomas Fitz Eustace Fitz Stephen.61 Her husband, living, as we have already seen, in June 1222, was deceased Feb. 22, 1223, when the Sherifi‘s of Lincolnshire and Northamptonshire were apprized that his son and heir Thomas had fined ten merks for his relief, and was to have seizin of such lands as his Father had held in clzpz'te.62 Joan Noel, his Mother, was living, and still so called in 1235; and she gave her share of Alveley to her younger son Ralph, who seems to have adopted his Mother’s maiden name of Noel. Hence in 1255, we find Ralph Noel holding a quarter of a hide in Alveley, or a third part of that estate there, which the Record represents as divided among three Coheirs only, and constituting half a Knight’s fee. After this, Ralph Noel sold both his share of Alveley and his interest in Badger to William de Hempton, of whom I have already spoken in connection with the latter Manor.63
“1 Erdeswick (Swrvey qj' Stafibrdshire) mentions William de Duston as the busband of Joan Noel, and as the Progenitor of her heirs. Dugdale (History of WW
wickshire) has namedThomasFitz Eustace only as her husband. Baker (History qf Northamptomhire) has endeavoured to combine the two statements, by making Fitz Eustace her first and Duston her second husband,—an unfortunate compro— mise, for it happens that the first thus alleged husband survived the last.—
The truth is that Duston was never Joan Noel’s husband at all, and the reason why he has been put down as such is, that he had a great Charter of Feofl‘ment from Thomas Noel, Joan’s Father, not however as a Son-in-Law, but only as a Feofl'ee.
