**********************************
SIR BERNARD FRASER, first of Touch-Fraser, Vicomes of Stirling in 1234, had a daughter Helen who became a nun.
In the reign of Alexander the Second (1214-1249) the chief of the family was Bernard de Fraser, supposed to have been the grandson of the above-named Gilbert, by a third son, whose name is conjectured to have been Simon. [Anderson’s Hist. Acc. of the frasers, p. 8.]
Bernard was a frequent witness to the charters of Alexander the Second, and in 1234 was made sheriff of Stirling, an honor long hereditary in his family. By his talents he raised himself from being the vassal of a subject to being a tenant in chief to the king. He acquired the ancient territory of Oliver castle, which he transmitted to his posterity. He was one of the magnates of Scotland who swore to the performance of the treaty of peace agreed upon between Alexander the Second and Henry the Third of England at York in 1237.
He is said to have married Mary Ogilvie, daughter of Gilchrist, thane of Angus, whose mother, Marjory, was the sister of Kings Malcolm the Fourth and William the Lion, and the daughter of Prince Henry. He was succeeded by his son Sir Gilbert Fraser, who was sheriff or vicecomes of Traquair during the reigns of Alexander the Second and his successor. He had three sons; Simon, his heir; Andrew, sheriff of Stirling in 1291 and 1293; and William, chancellor of Scotland from 1274 to 1280, and bishop of St. Andrews from 1279 to his death in 1297.

=== Sir Gilbert Fraser, probably a brother o ===
Sir Gilbert Fraser, probably a brother of Sir Bernard and Adam Fraser, is the direct ancestor of the Frasers of Philorth. He is first found in or before 1214 witnessing a charter by Nesius, son of Nesius, to the monks of Newbottle. In 1233 King Alexander II addressed a precept to Gilbert Fraser, Sheriff of Traquair, ordering him to try a cause between William, Bishop of Glasgow, and Mariota, daughter of Samuel, who resigned her claim to the lands of Stobo. He also, as Sheriff, in the same year witnessed a resignation of those lands by Eugene, son of Anabell, another daughter of Samuel. He had a mandate from Alexander II to imprison all excommunicated persons whom the Bishop of Galsgow should report as having been for forty days under the censure of the Chruch. As Sheriff of Traquair, he witnessed a charter by "Christiana quondam filia Ade filii Gilberti' to the chapel of St Mary of Ingolfiston between the years 1233 and 1249.
In 1259 as assize was held in the court of 'Gilbertus Fraser miles vicecomes de Peebles.' One of the members was Nes Fraser. Nes Fraser and Laurence Fraser swore with EArl Patrick in 1244 that they had no part in laying wast the King of England's land in Ireland or elsewhere, nor received any of his enemies. The above records prove that Sir Gilbert Fraser was Sheriff both of Traquair and Peebles. He died probably about 1263, as the next year his son is mentioned as Sheriff of Peebles. [The Scots Peerage VII:420-421]

Sir Gilbert Fraser of Oliver Castle, "Vicecomes de Traquair," who flourished during the reign of Alexander III. He is believed to be the second holder of the name of the Sheriffship of Traquair. An important lawsuit between William, Bishop of Glasgow, who held that see from 1233 to 1258, and a lady named Mariota, was transmitted by the King's precept to and tried before Sir Gilbert "tunc Vicecomes de travquair," the result of which was that Mariota resigned her claim to the lands in question "in curia vicecomitatu de Travquair." He is witness to a charter by Eugine, son of Amabill, in which he resignes his mansion of Stobo to Bishop William of Glasgow, and as Sheriff of Traquair he witnesses a charter by Christiana, granting certain lands to the Chruch of St Mary, during the reign of Alexander III. Sir Gilbert Fraser, whose wife's name was Christian, died about 1263 leaving a family of four sons, John, Simon, Andrew and William. The eldest, John, predeceased his father; Andrew did homage to King Edward I at Dunfermline in 1291, and died before 1308; William was a famous man in his day: he took holy orders, became Dean of Glasgow, was Chancellor of Scotland (1274), and Bishop of St. Andrews (1279). After the death of King Alexander III. (1285-6) he was elected one of' the three regents for the North, along with Duncan, Earl of Fife, and Alexander Comyn, Earl of Buchan. He was also one of the King's executors. He died abroad in the year 1297. Direct ancestor of the Frasers of Muchalls and the Frasers of Philorth. Also thought to be the direct ancestor of the Frasers of Lovat, of Strichen, of Inverallochy, etc.
=== John Fraser, the eldest son of Sir Gilbe ===
John Fraser, the eldest son of Sir Gilbert, is first mentioned in the 'Liber Vitæ' of Durham, 'Gilbertus Fraser et Christiana uxor ejus et Johannes filius eorum.' He appears never to have succeeded in his father's estates, but to have predeceased him, as after Sir Gilbert's death his lands are held by Richard Fraser, who was the proprietor of the lands of Rig near Arkelton, which John Fraser got by his marriage, before 1243 (in which year Roger Avenel died), with Alicia, daughter of William de Conigburg, Lord of Stapilgorton, and which his father-in-law held as a feudatory of Roger Avenel. Lord of Eskdale. [The Scots Peerage VII:423-424]
