Records refer to Alice by various names. She is often listed as Alice of Warkworth in apparent reference to Warkworth Castle where she was born. She is called Alice Roger and Alice FitzRoger after her father Robert FitzRoger. She is called Alice FitzRobert also after her father, and she is called Alice Clavering, again for her father Robert, Lord of Warkworth and Clavering.
She married Peter FitzHerbert, who is named as one of the Barons in the Magna Charta. Her brother, Baron John FitzRobert, was one the the twenty-five "Surety Barons for the Enforcement of the Magna Charta", thus also a signatory to the Magna Carta signed by King John in 1215.
The book "A Genealogical History of the Dormant, Abeyant, Forfeited, and Extinct Peerages of the Bristiah Empire" states: "Peter Fitz-Herbert, who, being very obsequious to King John, was reputed one of that prince's evil counsellors. In 1214, he was constituted governor of Pykering Castle, Co. York, and sheriff of the shire: but afterwards falling off in his allegiance, his lands at Alcester were seized by the crown, and given to William de Camvill. Returning, however, to his duty upon the accession of Henry III, those lands were restored to him. He m. 1st, Alice, dau. of Robert Fitz-Roger, a great baron of Northumberland, but by her had no issue; and secondly, the 3rd dau. and co-heir of William de Braose, Baron of Brecknock, and d. 1235, leaving a son, Herbert Fitz-Peter, who, in the 26th Henry III, had a military summons to attend the king into France. He d. soon after, however, (anno 1247), and, leaving no issue, was s. by his brother Reginald Fitz-Herbert."
The book "A Genealogical and Heraldic History of the Commoners of Great Britain and Ireland" states: "Peter Fitz-Herbert, Baron of Berstaple in Devonshire, the honor of which he obtained from King John, with fifteen knight's fees, part of the lands of William de Braose, and he was made Governor of Pickering Castle in Yorkshire, and Sheriff of that county by the same monarch. This Peter was one of the barons named in Magna Charta, and by his signature fourth in rank amonst the barons. He m. first, Alice, dau. of Robert Fitz Roger, a great baron in Northumberland, Lord of Warkworth and Clavering....By this lady he had a son and heir Reginald Fitz Peter. He m. secondly Isabel, dau. and coheir of William de Braose, and widow of David Llewellin, Prince of Wales, and by the alliance acquired the lordships and castles of Blenlevenny and Talgarth in the county of Brecknock, with other possessions in Wales. He forfeited his castle of Blenlevenny, and dying in 1235 was s. by his son, Reginald Fitz Peter, Lord of Blenlevenny, with its members de la Mere and Talgarth."
The Annuals and Antiquities of the Counties and County Families of Wales states: "Peter Fitz (or son of) Herbert was one of the barons who signed Magna Charta. He m., 1st, Alice, or Alis, dau. of Robert Fitz Roger Lord of Warkworth and Clavering, and had a son and h...Reginald, son of Peter."
However, the "Family of Herbert" in Archaeologia Cambrensis provides the following information: "By Alice, his wife, Peter Fitz-Herbert had three sons, Robert, Herbert, and Reginald. He married, secondly, Isabella Ferrers, widow of Roger de Mortimer, but by her had no issue. Peter Fitz-Herbert died in, or previously to, 13th Henry III [1229]. Isabella, his second wife survived him..." In a footnote, the Archaeologia Cambrensis continues: "Among other errors of Sir William Dugdale, published (as 'corrections' by him) in the "Collectanea Topographica et Genealogica", is a statement that Peter, son of Herbert, married his third wife, 'Isabell the daughter and coheir of William de Braose of Brembre (an eminent Baron), widow of David ap Llewelyn, Prince of Wales, by which Isabell he had the Lord of Blenleveny, Tolgard, and Walashire, in the county of Brecknock, with other lands in several parts of Wales.' This statement is untrue, and in point of fact impossible. Untrue, because, as may be seen by a reference to the first volume of Jones's "History of Brecknockshire", the Lordships of Blaenllyfni and Talgarth, together with the honour and castle of Dinas, were given to Peter Fitz-Herbert by King John, to whom they had escheated by the attainder of William de Braos; and impossible, because Peter Fitz-Herbert died in or before the 13th Henry III, and Isabella de Braos, as may be seen by the Rolls of Parliament, was living as the wife of David ap Llewelyn in the 16th Henry III [1232], and David himself was living on 7th of June, 1245, in the 29th Henry III..."

"The Herbert family claimed descent from 'Herbertus Camerarius,' a companion of William I, and his son 'Henry Thesaurarius,' both of whom were tenants in capite in Hampshire. The descendants of Henry Thesaurarius in the fifteenth-century claimed that he was 'son natural of King Henry the First,' and that they were thus connected with 'the Royal Blood of the Crown of England,' but the pretension contradicts established fact. Peter, the great-grandson of Henry Thesaurarius, seems to have been the first of the family to settle in Wales. He received from John in 1210 many grants of land there forfeited by William of Braose, Peter's descendants by intermarriages with Welsh heiresses acquired very large estates in South-east Wales, and practically became Welshmen...."

It is apparent that many records disagree on some particulars concerning Peter. For example, his death is listed as 1229 and 1235. However, despite the disagreements, it seems certain that he could not have been married to Isabel de Braose who was still married to her first husband, David ap Llewelyn, after Peter died. Peter's second wife was almost certainly Isabella Ferrers. It also appears very likely that all of Peter's sons were born to his first wife, Alice. Perhaps the most interesting particular concerning Peter FitzHerbert is his involvement with signing the Magna Charta. In fact, he is one of the men actually named by name in the body of the Magna Charta, signed by King John on June 15, 1215 at Runnymede, England.
